Exemptions in New Jersey

Federal OBBBA exemption categories apply to New Jersey expansion adults. New Jersey Department of Human Services has not published state-specific exemption-processing guidance as of 2026-09-20, so the federal categories are the operative list for now.

The June 2026 interim final rule requires a two-step test: a serious or complex medical condition that significantly impairs the ability to complete 80 hours a month. Diagnostic codes alone are not enough. Verified medically-frail status must be re-verified at least every 12 months.

80 hours per month of work or qualifying activity — employment, education, job training or community service. The rules also recognize an income alternative: earnings of at least $580 a month (80 hours at the $7.25 federal minimum wage) can satisfy the requirement through income instead of hour tracking, and seasonal or irregular earnings may be averaged.

What counts as a work, training or education program in New Jersey?+

The 80 hours do not have to come from one paid job. New Jersey counts employment (including self-employment and gig work), community service / volunteering, job training and workforce programs, education at least half-time, caregiving (counts as qualifying activity in federal framework) and combination of the above totaling 80 hours/month, and activities can be combined to reach the monthly total — so a training course or a part-time education program can satisfy the requirement on its own, or make up the gap left by work.

Who is exempt from the New Jersey work requirement?+

Federal law exempts parents and caretakers of children under 14, pregnant and postpartum women, people receiving disability benefits, the medically frail, students enrolled at least half-time, former foster youth up to 26, and people already meeting TANF or SNAP work rules.
